Section 37.105 - Non -authorized persons: rejection of input, design, identification, tex.educ.Code § 37.105 (2024)

(in)A school manager, the resource manager of the school or the peace officer of the school district in a school district can refuse to give a person the opportunity to come in or can push a person out of ownership during the check of the district if the person refuses peacefully upon requestto leave and:
(1)The person is a significant risk of injury to each person;
(2)The person behaves in a way that is inappropriate for a school environment and:
(IN)The manager, resource manager or peace officer broadcasts an oral warning for the person that the person's behavior is inappropriate and can lead to the person rejection by the person;
(B)The person remains in this behavior.
(B)Identification may be required by a person on the property.
(C)Each school district has issued an overview of each verbal warning in accordance with subsection (1).
(D)The moment a person is refused access to or pushed out of the ownership of a school district under this section, the district provides the person who is written information explained in the professional process that is laid down in paragraph 1.h).
(e)If a parent or guardian of a child who is registered in a school district is refused access to the ownership of the district during this section, the district must accommodate the parent or guardian to ensure that the parent or guardian can participate in admission,Assessment of the child and dismissal committee or founded in the children's team under section 504, Rehabilitation Act of 1973 (29 U.S.C.) in accordance with the federal law.
(F)The term for the rejection of a person by accessing or drawing up the ownership of a school district under this section may not be longer than two years.
(G)A school district must be placed on the website of the district and each district campus must be reported on every website on campus about the provisions of this section, including the professional process in section 1.H).
(H)The Commissioner takes rules to implement this section, including rules that create a process for a person to appeal to the board of the school district, the decision in accordance with paragraph 1.
